In a strongly worded observation, Chief Justice of India Surya Kant remarked that tribunals have become “a liability” for the judiciary and a “headache” for the government.

A Bench comprising CJI Surya Kant and Justices Joymalya Bagchi and Vipul Pancholi flagged systemic issues in tribunal functioning, including lack of accountability and concerns regarding members outsourcing judgment writing.

The Court referred to ongoing concerns around reforms under the Tribunals Reforms Act, 2021, reiterating the need for a National Tribunals Commission to ensure structural safeguards in appointments and administration.

The Bench warned that functional crises, including absence of chairpersons, cannot be allowed to paralyse key tribunals.
